About these terms
These terms apply to products you buy from Lomond Furniture through lomondfurniture.co.uk. Please read them before you order.
Nothing in these terms reduces your statutory rights as a consumer. Where a term and the law disagree, the law applies.
Our Privacy Policy, Cookie Policy, Delivery Information and Returns & Refunds pages sit alongside these terms and are referred to where relevant. Browsing this website is not an agreement to buy anything — a contract is only formed through the ordering process described below.
Who you are buying from
This shop is operated by Lomond Furniture. “Lomond Furniture & Homeware” is the brand this shop trades under; the trader you are contracting with is Lomond Furniture.
Our business address is 4 High Street, Leslie, Fife, KY6 3DA, United Kingdom.
You can contact us at support@lomondfurniture.co.uk. This is the address for questions about an order, for returns and for complaints.
We are not VAT registered, so no VAT is added to any price and no VAT number is shown.
Using this website
You may use this website to browse the range and to place an order. Please do not use it in a way that interferes with it working for anyone else.
We may change the range, prices and content of the site at any time. A change made after your order has been accepted does not affect that order.
Products and product information
We describe each product as accurately as we can. Photographs are intended to represent the item, but screens reproduce colour differently and a finish may look different in your home from how it looks on your device.
Where a product is made from a natural material, small variations in grain, colour and figuring are part of the material rather than a fault.
Please use the specifications on the product page rather than the photograph when a measurement matters. Product pages give assembled dimensions and, where we have them, the number of packages and the heaviest package weight. A packaged item is usually larger than the assembled one.
Where a product is sold in more than one size, colour or configuration, the version you selected is what is supplied — it is shown in your basket and on your order confirmation.
Prices
Prices are shown in pounds (GBP) and are the final price payable for the goods. We are not VAT registered, so no VAT is added at any point.
Delivery is shown separately, calculated from the products in your basket, unless your order qualifies for free delivery. Your basket shows the delivery charge that applies before you go to checkout, and the total you will pay is shown before you submit your order.
Prices can change, but the price that applies to your order is the one shown when you place it.
Placing an order
To order, you choose a product and any options it offers, add it to your basket, and go to checkout. At checkout you give us the information we need to fulfil and deliver the order, and you submit the order.
Please check your order before submitting it. If you spot a mistake afterwards, contact Customer Care as soon as you can and we will correct it if we can.
When a contract is formed
When you submit an order you are making us an offer to buy the goods you have selected. We are not obliged to accept it.
The acknowledgement we send straight afterwards confirms that we have received your order. It is a receipt, not an acceptance, and by itself it does not create a contract.
Your card may be authorised or charged as part of checkout. That does not mean we have accepted the order either. If we cannot accept it after payment has been taken, we refund you.
The contract between us comes into existence when we send you dispatch confirmation for the goods. Where an order contains several items, a contract is formed for each item as it is dispatched.
This website does not currently accept orders. No payment method is configured, so no order can be placed at present.
Payment
No payment method is enabled on this website, so no payment can currently be taken and no order can be completed.
When ordering opens, payment will be handled by a payment provider and this section will name the methods actually accepted. We will not list a card type or a payment method we do not take.
Payment being authorised or taken does not mean an order has been accepted — see the section above. Where we cannot accept an order for which payment has been taken, we refund it.
Availability, and when we may decline an order
Orders depend on the product being available. Although we keep the site up to date, an item can occasionally turn out to be unavailable after an order is placed.
Before we accept an order — that is, before we send dispatch confirmation — we may decline it. We would only do so for a genuine reason, and the reasons are: the product is unavailable; payment could not be authorised; we cannot deliver to the address given; a genuine and material error in the product description or price; or we are otherwise unable to fulfil the order.
If we decline an order we will tell you and explain why, and we will refund anything you have paid for it. Once we have accepted an order, we cannot simply cancel it: from that point the ordinary contractual and statutory position applies to both of us.
We will not send you a different product instead of the one you ordered without agreeing it with you first.
If a price is wrong
Prices come from our own systems and, very occasionally, one can be wrong.
Where we spot a genuine and material pricing error before we have accepted your order, we will contact you, explain it, and either give you the chance to order again at the correct price or decline the order and refund you in full. We will not simply process an order at a price that is obviously wrong without telling you.
Once we have accepted your order we do not claim a general right to cancel it because we would rather have charged more. What can be done after that point depends on the circumstances and on the law.
Delivery
Delivery is charged once per order. Where a basket contains items needing different services, the largest service required governs the whole order — you are not charged per item.
We deliver within Great Britain. Some remote areas — including the Scottish Highlands and islands — may need different arrangements, so please contact us before ordering if you are outside mainland Britain.
We do not publish a delivery window, because we will not give you a date we cannot stand behind. Delivery timing is confirmed with you once your order is ready to be dispatched.
Access and measurements
Furniture has to get into the room it is going in. Before ordering, please check that the packaged item will pass through doorways, hallways, stairs, landings and lifts, and that the route to the room is suitable.
Product pages give the assembled dimensions and, where we have them, the number of packages and the heaviest package weight, so that you can check this before you buy. We cannot carry an item through a space it does not fit.
This section is about access, not about the goods themselves. If an item is faulty, damaged or not as described, your rights are set out below and are not affected by anything here.
Assembly
Items are delivered as supplied, in their packaging. Most flat-packed furniture needs home assembly, and assembly is not included in the delivery service.
Each product page sets out what that item requires under Delivery & Assembly.
Changing your mind
Because you are buying at a distance, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel within 14 days of receiving the goods, and a further 14 days to return them once you have told us.
You do not need a reason. Tell us through Customer Care and we will confirm the arrangements for that piece — where and how an item goes back depends on the item.
Where the law allows it and we have told you the cost before you ordered, you are responsible for the direct cost of returning the goods. Most furniture cannot sensibly go back by post, so we can arrange collection; the collection charge is the genuine cost of collecting that piece and is set out in our Returns & Refunds information before you buy. It is not a fee for changing your mind, and we do not charge a restocking fee.
You may handle and inspect the goods as you reasonably would in a shop — unpack them, look at them, see how they work. If you go beyond that and the value of the goods is genuinely reduced as a result, we may deduct an appropriate amount from your refund to reflect that. Opening the packaging, on its own, is not a reason for a deduction, and neither is cancelling.
Returning an item
Start a return through Customer Care, choosing Returns & refunds. Give us your order details and the piece involved and we will confirm how it should come back.
Please do not send an item back before we have confirmed the arrangements — we may not be able to trace it.
Where a return is because you have changed your mind, the direct cost of getting the goods back to us is yours, as set out above. Where it is because something is wrong with them, it is ours.
Faulty, damaged or misdescribed goods
Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality.
If goods do not meet that standard you have a short-term right to reject them within 30 days of delivery, and after that the right to ask for a repair or a replacement, and — if that does not put things right — a price reduction or a final right to reject. These are your rights under the Act and nothing on this page reduces them.
Tell us through Customer Care, choosing Problem or complaint, and send photographs if the problem is something we can see. Please keep the packaging until the item has been checked.
Where goods are faulty, damaged, not as described or simply not what you ordered, WE bear the cost of getting them back — you are not asked to pay to return something that should not have arrived in that condition. The change-of-mind collection charge does not apply.
Something missing from your order
If an item, a package or a part is missing, tell us through Customer Care with your order details and we will sort it out.
Furniture often arrives in more than one package, and packages in the same order do not always arrive together. Product pages state the number of packages where we have it.
Refunds
Where you cancel under your distance-selling rights, we will refund you within 14 days of receiving the goods back, or of your giving us evidence that you have sent them, whichever is earlier. Where no goods are involved, the 14 days run from the day you told us you were cancelling.
A refund is made using the same means of payment you used, unless we agree something else with you, and we will not charge you a fee for making it.
A refund on cancellation also includes what you paid for delivery. We offer a single delivery service per order rather than a choice of speeds, so there is no upgrade to hold back — you get the delivery charge back in full.
If you are returning only part of an order, we refund the goods you send back. Whether the delivery charge is refunded depends on what remains, and we will confirm that with you.
Once we have issued a refund, how long it takes to appear depends on your bank or card provider rather than on us.
Cancelling before dispatch
If you want to cancel an order that has not been dispatched, contact Customer Care as soon as you can and we will stop it if we still can. There is no automatic cancellation button on the site.
This is separate from — and additional to — your statutory cancellation rights described above.
Risk and ownership
Under the Consumer Rights Act 2015, goods remain at our risk until they come into your physical possession, or into the possession of someone you have identified to take delivery of them.
You own the goods once we have received payment in full for them.
Delays outside our control
Occasionally something outside our reasonable control delays an order — severe weather, serious transport disruption, an interruption at a supplier, or a failure of infrastructure we depend on.
If that happens we will contact you, explain what has happened and tell you what we expect to do about it. Where the delay is substantial you may cancel and be refunded for anything you have paid for and not received. This section does not affect any right you have under consumer law.
Our responsibility to you
If we fail to comply with these terms we are responsible for loss or damage you suffer that is a foreseeable result of that failure. Loss or damage is foreseeable if it is obvious that it will happen, or if both of us knew it might when the contract was made.
We do not exclude or limit our liability to you in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any liability under the Consumer Rights Act 2015 or the Consumer Protection Act 1987 that cannot lawfully be excluded.
We supply these products for domestic and private use. If you use them for any commercial purpose we will have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
Your responsibility to us
Please give us accurate contact and delivery details, tell us about anything at the delivery address that would make access difficult, and make sure someone is able to receive the delivery at the agreed time.
Please also make sure the route into the property is safe for the people delivering. If a delivery cannot be completed for a reason within your control, we will contact you to arrange another.
Privacy and personal information
We handle your personal information in accordance with our Privacy Policy, which explains what we collect, why we hold it and the rights you have over it.
Complaints
If something has gone wrong, tell us through Customer Care and choose Problem or complaint. That routes your message to the right place with the details we need to look into it. You can also write to us at support@lomondfurniture.co.uk.
We would always rather hear about a problem than not.
Changes to these terms
We may change these terms from time to time. The terms that apply to your order are the ones published when you placed it, and we do not apply a later change to an order already accepted.
The date this page was last updated is shown at the top.
Governing law
Lomond Furniture trades from Scotland, and these terms are governed by the law of Scotland. Any dispute may be brought before the Scottish courts.
If you live in England, Wales or Northern Ireland, this does not take away the protection given to you by the mandatory consumer law of the part of the United Kingdom where you live, and you may bring proceedings in your own local courts.
